Erie County District Attorney Frank J. Clark is willing to adopt a tougher plea-bargaining policy for DWI defendants, and he has instructed his staff to review past cases to see if the change he has in mind would make a dent in drunken driving. Clark now allows plea bargains for first-time offenders with blood alcohol levels up to 0.15 percent. But before year’s end, he anticipates refusing to plead down if a driver’s Breathalyzer reading is above 0.13 percent. Source : nl.newsbank.com |
